01. POLICY
STATEMENT
01.01 This UPPS establishes policies associated with
fees and collection of outstanding parking violation fees.
02. PROCEDURE FOR
ASSESSING AND COLLECTING FEES
02.01 The assistant director of Parking Services
will manage and supervise the collection and recording of fees related to
parking violations.
02.02 All vehicles driven or parked on Texas State
property are subject to the laws of the State of Texas and Texas State rules
and regulations. Fees for parking violations are as follows:
Improper

Expired
Meter $ 15.00
Parked
in Disabled Zone $100.00
Use
of Altered/Forged/Lost/Stolen/Fraudulent
Permits $150.00
Boot
Removal $ 40.00
Chronic
Offender Fee $150.00
All other violations of University Traffic
and Parking $ 40.00

Each
violation alleged on a violation notice is assessed a separate fee.
02.03 Violators must make payment to Parking
Services, in person, online, or by mail within 10 working days from the date of
issuance of the violation notice. Payments made by regular mail are considered
received on the date postmarked by the United States Postal Service. Payments
made via campus mail are considered received on the date payment is delivered
to Parking Services.
02.04 A late fee of $15.00 shall be assessed for all
violation notices that remain unpaid after 10 working days from issuance of the
violation notice.
02.05 Students, faculty, and staff may appeal
parking violations. Refer to the Traffic,
Parking and Safety Regulations for proper appeal procedures. The final determination of violation appeal
hearings is recorded. Any fee assessed and paid is refunded to violators who
receive a non-guilty verdict on their appeals.
03. PROCEDURES
FOR HANDLING UNPAID PARKING VIOLATION FEES
03.01 Unpaid charges for violations are recorded in
either the name of the student, faculty, or staff person who:
a. bought
the permit displayed, or who had previously bought a permit for that vehicle;
b. has
previously paid violations on that vehicle;
c. was
identified as the owner of the vehicle; or
d. under
the name of the current student, faculty, or staff person who has the same last
name and home address of the registered owner of the vehicle.
1) Faculty and Staff – Each fall and spring
semester, the assistant director of Parking Services will send a notice to the
last known address of the person in whose name one or more unpaid violation
fees are recorded. Such notice shall state that unless payment of all
accumulated fees is made within 10 calendar days after the date of such notice,
campus parking privileges for that person will be suspended and appropriate
enforcement action, including booting or towing, will take place without
further notice. Employees having one or more unpaid parking violation fees will
be refused the purchase of a parking permit.
2) Students – Once each semester, the assistant
director of Parking Services will send a notice to the last known address of
the person in whose name one or more unpaid violation fees are recorded. Such
notice shall state that unless payment of all accumulated fees is made within
10 calendar days after the date of such notice, campus parking privileges for
that person will be suspended and appropriate enforcement action, including
booting or towing, will take place without further notice. Students having one
or more unpaid parking violation fees will be refused the purchase of a parking
permit.
3) Unidentified Vehicle Operators – Once each
semester, the assistant director of Parking Services will send notification
that parking privileges have been suspended to the last known address of the
person in whose name any unpaid violation fees are recorded. Such notice shall
state that unless payment of all accumulated fees is made within 10 calendar
days after the date of such notice, campus parking privileges for that person
will be suspended and appropriate enforcement action, including booting or
towing, will take place without further notice.
03.02 According to Texas State's Traffic, Parking
and Safety Regulations, parking a motor vehicle on campus
when parking privileges have been suspended is an impound or boot violation regardless
of whether the vehicle has a valid permit.
03.03 Campus parking privileges are suspended for
unpaid violation fees as follows:
a. Faculty and Staff – Texas State employees
with one or more unpaid parking violations are not allowed to purchase a new
parking permit until all fees are paid.
b. Students – Students in whose name unpaid
violation charges are recorded shall be suspended from re-enrollment or
re-admission to the university and official transcripts and diplomas shall be
withheld until such unpaid fees are satisfied. Students with one or more unpaid
parking violations are not allowed to obtain a parking permit until all fees
are paid.
04. PROCEDURES
FOR RETENTION OF PARKING VIOLATIONS
04.01 Parking violations are held in an active
status for five years after a student leaves the university. Faculty and staff
parking violations are held in active status for five years after leaving
university employment.
04.02 In July of each year, the assistant director of
Parking Services will be responsible for purging all inactive violation fee
records older than five years. Parking Services will release all records
(including transcripts, enrollment and diploma holds) and take no further
action.
